The My Health Consult Terms and Conditions was updated on June 18, 2021. 

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE

The following Terms and Conditions govern and apply to your use of or reliance upon this website maintained by My Health Consult.
Your access or use of this website indicates that you have read, understand, and agree to be bound by these Terms and Conditions and any other applicable laws, statutes, and/or regulations. Please be aware that we may update and modify these Terms and Conditions at any time. To remain up to date with any changes, please review this section each time you access and/or use My Health Consult. 

ACCOUNT AND ACCOUNT USE

  1. If your use of My Health Consult requires an account identifying you as a user of the website (an "Account"):
  2. you are solely responsible for your account and the maintenance, confidentiality, and security of your account, any passwords related to your account, and any and all activities that occur under your account including all activities of any persons who gain access to your account with or without your permission;
  3. you agree to keep your password confidential and not to share your login information with any person for any reason; 
  4. you agree to immediately notify us of any unauthorized use of your account, any service provided through your account, or any password related to your account and/or any other breach of security with respect to your account or any service provided through it, and you agree to assist us, as requested, to stop or fix any breach of security related to your account;
  5. you agree to provide true, current, accurate and complete account information as requested by us from time to time and you agree to promptly notify us of any changes to this information as required to keep such information held by us current, complete, and accurate; and 
  6. you agree to provide My Health Consult with a current and valid healthcare practicing permit before verifying an account (i.e. Medical Licenses are required for Family Physicians). If the healthcare practicing permit is invalid or out of date, your account will not be approved. Under these circumstances, My Health Consult has the right to terminate any account without an active permit submitted and approved by our team.  

PAYMENT

  1. When selecting and purchasing a Payment Plan on the website, you agree to provide a valid instrument to perform monthly payments. 
  2. When you provide a payment instrument to us, you confirm that you are permitted to use that payment instrument. When you make a payment, you authorize us (and our designated payment processor) to charge the full amount of the payment instrument you designate for the transaction. You also authorize us to collect monthly payments for both the Basic, Premium, and Facility plans unless cancelled. 
  3. After initiating your monthly payment plan, you will be notified immediately that your initial payment process has been confirmed. You agree that after this initial confirmation there is no way to remove the first month's payment once the plan has commenced. 
  4. For all future monthly subscription payments, the plan may be terminated when given more than 24 hours notice on the website to 'Cancel Payment Plan' prior to the next payment. You agree that canceling a monthly subscription payment within the 24 hour period of your next payment will not authorize an immediate cancellation. 
  5. In order to prevent financial loss to you or to us, we may contact your funding instrument issuer, law enforcement, or affected third parties (including other users) and share details of any payments you are associated with, if we believe doing so may prevent financial loss or violation of law. 

ACCEPTABLE USE

You agree not to use My Health Consult for any unlawful purposes, or any purpose prohibited under this clause. You agree not to use My Health Consult in any ways that could damage the website, the services, or the general business of My Health Consult. 
You further agree not to use and/or access My Health Consult:
  1. to harass, abuse, or threaten others or otherwise violate any person's legal rights;
  2. to violate any intellectual property rights of us or any third party;
  3. to allow for the transmission of any confidential patient information;
  4. to upload or otherwise disseminate any computer viruses or other software that may damage the proper of another;
  5. to perpetrate any fraud;
  6. to publish or distribute any obscene or defamatory material; 
  7. to publish or distribute any material that incites violence, hate or discriminations towards any group; or 
  8. to unlawfully gather information about others

PROTECTION OF PRIVACY

  1. Through your use of My Health Consult, you may provide us with certain information. By using the website, you authorize us to use your information in Canada and any other country where we may operate.
  2. When you register for an account, you provide us with a valid email address and full name as well as any additional information such as your medical license, billing information, etc. Depending on how you use My Health Consult, you may provide us with additional information to personalize your account. 
  3. We use the information gathered from you to ensure your continued good experience on our website, including through email communication. We may also track certain of the passive information received to improve our marketing analytics, and for this, we may work with third-party providers.
  4. If you would like to disable our access to any passive information we receive, you may choose to disable cookies in your web browser. Please be aware that we will still receive information about you that you have provided, such as your email address and any other public-facing information on your account. 
  5. If at any time you would like to disable your account and retract any information from our website, you may do so by selecting the "terminate your account" option within your account information. Immediately after selecting the termination option, your information will be deleted from the public view. However, My Health Consult will store your information for a reasonable period of time to be determined by us in accordance with applicable federal and provincial laws. After this period, all information about you will be deleted.

DATA LOSS

We are not responsible for the security of your account or content. Your use of the website is at your own risk.

SERVICE INTERRUPTIONS

We may need to interrupt your access to My Health Consult to perform maintenance or emergency services on a scheduled or unscheduled basis. You agree that your access to My Health Consult may be affected by unanticipated or unscheduled downtime, for any reason, but that we will have no liability for any damages or loss caused as a result of such downtime. 

TERMINATION OF ACCOUNT

We may, in our sole discretion, suspend, restrict, or terminate your account and your use of My Health Consult, effective at any time, without notice to you, for any reason, including because the operation or efficiency of the website or our third-party's equipment or network is impaired by your use of the website, we have received a third-party complaint which relates to your use or misuse of My Health Consult, or you have been or are in breach of any terms or conditions using these Terms and Conditions. We will have full responsibility to notify any third-party, including any third-party providers of services, merchandise or information, or any suspension, restriction, or termination of your access to My Health Consult.
